Who sells

The Vivapse playground at vivapse-playground.space is sold by Emeric Daumarie, an individual (ingenieur.space). Contact: emeric.daumarie00@gmail.com.

What you buy

Access to the playground, the browser simulator. The documentation and the courses on vivapse.space are free and are not part of any purchase.

• Personal — $3, paid once. Access for the account that bought it, for as long as the playground is operated. It is personal and may not be shared.
• Class of 10 / Class of 20 — $15 / $25. Ten or twenty student seats in a class the buyer teaches, for twelve months from the day of purchase. Packs add up, each ends on its own date, and none renews automatically. The teacher creates the class, hands out its class code, and may remove students to free their seats. When no pack of a class is active, its students lose access until a new pack is bought; the class and its students are kept.

Prices and payment

Prices are in US dollars. Any tax that applies where you are is calculated and shown at checkout, before you pay. Payment is taken by card through Stripe's checkout; we never see or store your card details. Access is given as soon as Stripe confirms the payment, usually within seconds.

Your right of withdrawal

If you buy as a consumer in the European Union, you normally have fourteen days to withdraw from a distance purchase. The playground is digital content supplied at once: at checkout you ask for immediate access and acknowledge that you lose that right once access is given (Article L221-28 13° of the French Consumer Code, Article 16(m) of Directive 2011/83/EU). A school or a teacher buying for their work buys as a professional and has no right of withdrawal.

Regardless of that: if the playground does not run on your device, write to us within fourteen days of your purchase and we will refund you.

Using the playground

You may use the playground for your own learning and, with a class pack, for teaching. You may not resell or share access, attempt to get around the access control, or disrupt the service. We may suspend an account that does, after telling you why when we can.

Your flights, vehicles and programs are kept in your browser, not on our servers; clearing your browser's storage removes them. Export or share them from the playground to keep a copy.

Availability and liability

We work to keep the playground available and correct, but it is a simulator: it approximates reality, as fidelity and its limits describes, and it must not be relied on for real flight, engineering or safety decisions. It may be unavailable at times for maintenance or for reasons beyond our control. Nothing in these terms limits the rights you have as a consumer under the law, including the legal guarantee of conformity for digital content.

Disputes

Write to us first at emeric.daumarie00@gmail.com; we answer every message. These terms are governed by French law; a consumer keeps the protection of the mandatory rules of the country where they live.

Changes

We may change these terms. A purchase stays governed by the terms in force on the day it was made.
